2. Overview
We process personal data only as far as necessary to run this website, sell the subscription and license the software. The software itself runs locally on your computer and does not send usage data to us.
3. Hosting of this website (Infomaniak)
This website is hosted by Infomaniak Network AG, Rue Eugène-Marziano 25, 1227 Les Acacias (GE), Switzerland. When you visit, the server processes technically necessary data (e.g. IP address, date and time, browser, page requested) in server log files. The legal basis is our legitimate interest in secure and stable operation (Art. 6(1)(f) GDPR). The EU Commission has adopted an adequacy decision for Switzerland. A data processing agreement is in place with Infomaniak.
This website sets no cookies, loads no external fonts or scripts and uses no tracking. Only when you click a buy button are you taken to Stripe (see section 4).
4. Purchase and payment (Stripe)
Subscriptions are paid via Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. Stripe processes in particular your name, e-mail address, billing address and payment data. We receive your name, e-mail address and subscription and payment status from Stripe, but no full card details. The legal basis is the performance of the contract (Art. 6(1)(b) GDPR) and legal obligations (Art. 6(1)(c) GDPR). Stripe may transfer data to Stripe, Inc. in the USA; Stripe is certified under the EU-US Data Privacy Framework. Details: Stripe privacy policy.
5. Licence keys and customer administration
For your licence we store your name, e-mail address, licence key, subscription term ("paid until"), status and the Stripe IDs of your subscription. We keep this data in a non-public spreadsheet at Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). So that the software can check whether a licence is valid, we publish a list that contains only a non-reversible check value of the key, the expiry date and the status, but no names, e-mail addresses or keys. The legal basis is the performance of the contract (Art. 6(1)(b) GDPR).
6. Contact by e-mail
If you write to us or reply to our e-mails, we process your e-mail address and the content to handle your request (Art. 6(1)(b) or (f) GDPR). We use Outlook.com by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland.
7. The software on your computer
Your watchlist, settings and, if connected, data from your Interactive Brokers account are stored only locally on your computer and are not transmitted to us. To work, the software itself connects to:
- Licence check: the licence list is downloaded from Google servers; your IP address is transmitted to Google.
- Market and news data: prices and news are retrieved from Yahoo Finance; your IP address and the ticker symbols requested are transmitted.
- Optional Interactive Brokers: connection to your locally running TWS or IB Gateway (read-only). Interactive Brokers' own terms apply to its data processing.
8. Storage period
We store data for as long as the subscription exists and as needed to process it. Invoices and accounting records are kept for up to 10 years due to statutory obligations (§ 147 AO, § 257 HGB). The data is then deleted.
9. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You can withdraw consent at any time with effect for the future. Simply write to ITIngenieur@outlook.de. You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).
10. Obligation to provide data, no automated decisions
Your name, e-mail address and payment data are required for the purchase and licence; without them we cannot perform the contract. No automated decision-making, including profiling, takes place.
